Norfolk Man Arrested For DWI for the Second Time in a Month

On Saturday night about 9:45 p.m. the Stanton County Sheriff’s office dispatch was advised by Wayne County authorities that a out of state plated vehicle was about to enter Stanton County on Hwy 35 and was driving all over the roadway. About six minutes later a southbound Florida plated vehicle was observed by the Stanton County Sheriff’s office travelling on the shoulder of Hwy 35 and weaving back and forth. The vehicle was stopped and the driver appeared intoxicated. A records check revealed he was just arrested in August in Yankton, SD for DWI and was out on bond. The driver, Daniel Fallat, 37 of Norfolk failed roadside sobriety testing and was placed under arrest for DWI. He was transported to the Sheriff’s office where he provided a failing breath sample above the legal limit and was booked for Driving While Intoxicated and released on a preset court appearance bond. It was unclear if Fallat was legally in the country as he spoke no English and current federal law does not allow local law enforcement to enforce immigration status. “It is frustrating for everyone and especially law enforcement when people don’t take driving while impaired seriously and seem to have no concerns for other innocent travelers and just continue to drive drunk!” SHERIFF MIKE UNGER

Fallat
